Truck driver error is often the primary cause of truck accidents

Most drivers of passenger vehicles in Georgia would agree that being too close to an 18-wheeler can make them nervous. The size of a truck alone can be intimidating, but not knowing whether the driver will make a mistake and cause an accident may be at the forefront of the minds of many drivers. In many instances, those fears are founded since truck driver error is the primary cause of accidents involving trucks.

Truck drivers are required to follow the rules of the road just as any other driver is. However, the consequences of a truck driver failing to obey traffic laws often comes with higher injury and mortality rates. Obviously, it takes an 18-wheeler much longer to stop than a smaller vehicle due to its size and weight, and if one is traveling at a high rate of speed, stopping in time to avoid a collision can be nearly impossible.

Making unsafe lane changes, running another vehicle off the road and other irresponsible behavior can also lead to serious injuries or death. These erratic actions are often the result of road rage, inattention or fatigue. In other cases, either drugs or alcohol impairs the driver. Other than his or her driving habits, the condition of the truck and its load are also the responsibility of the driver. If a load is not properly secured, a tire is not safe or the truck has other mechanical issues, an accident can happen.

If you are involved in an accident with a truck where truck driver error was the cause, you may be able to file a personal injury claim seeking damages from both the driver and his or her employer. Similarly, if you have lost a loved one in such a crash, a wrongful death claim may be filed. Successful claims could result in an award of damages allowed under Georgia law.
