Fatal accident leads to criminal charges for a driver in Georgia

No Georgia motorist thinks that he or she may be involved in a car accident when leaving the house for the day. Undoubtedly, a young Summerville woman who was killed in a two-vehicle collision recently did not believe that drive would be her last. The other driver has been arrested on charges relating to this fatal accident.

The 18-year-old woman was driving her Volkswagen when a Chevy Blazer slammed into her on the driver's side door. According to authorities, the driver of the Blazer was attempting to cross U.S. Hwy 411 when the collision occurred. The driver, who survived the accident, was taken to a local hospital to be treated for his injuries.

While Georgia State Patrol continue their investigation into this fatal accident, they have called on their Specialized Collision Reconstruction Team for assistance in determining who was responsible for this fatal crash. Unfortunately, the reason for this accident is still unclear. However, the driver of the Blazer has been charged with vehicular homicide in the first degree, driving under the influence and three counts of violating the controlled substance act. The driver was apparently in possession of two prescription drugs and an unspecified amount of marijuana.

If prosecutors can prove that the driver of the Blazer is guilty of the crimes with which he was charged, the family may use any conviction secured as evidence of the driver's negligence in a separate wrongful death claim. If the family proves to the court's satisfaction that the driver was negligent in this fatal accident, damages may be awarded to the family. Any monetary compensation and/or restitution awarded may help provide the family of the deceased woman some financial support to help cover the monetary burdens associated with the loss of a loved one.
