One teenager in Georgia recently lost his life in a tragic car accident. The car accident happened on a Wednesday. It took place along Georgia Highway 5.
Police said a teenager, 16, was going north in a Chevrolet Malibu. All of a sudden, another vehicle hit his vehicle’s passenger side. The teen ended up dying in the collision.
The person who police said was driving the other automobile was also a teenager, 17. He was going south when the crash happened. Two people were in this teenager’s car. All three individuals suffered injuries and were transported to the hospital.
If it is determined that the 17-year-old cause the fatal car accident, this individual may face a wrongful death claim filed by the surviving loved ones of the teenager who died. He may also face personal injury claims filed by the passengers injured in his vehicle. Meanwhile, if the deceased teenager is determined to have caused the collision, his estate may be sued, and so may any separate owners of the vehicle he was driving at the time of the accident — or his parents, if applicable. A preponderance of the evidence is needed to establish liability in civil court, based upon a showing of negligence; only then will a judge adjudicate monetary damage claims in Georgia. Financial restitution in a successfully fought case cannot reverse the events that led to a person’s injury or death in a motor vehicle accident; however, it may help to address pain and suffering as well as emotional distress caused by the crash.
