One person died and two people were injured in a recent crash in Georgia, naturally leading to questions about what could have caused the fatal wreck. The car accident occurred along Highway 53. It happened on a Wednesday in late October.
Police said a 41-year-old woman was driving west on the highway in a pickup. All of a sudden, a crossover driven by a 72-year-old woman left a pharmacy parking lot and entered the highway. The woman was apparently trying to make a left turn. The truck’s driver was unable to stop in time, and she crashed into the driver’s side door of the crossover.
The crossover’s driver was transported to the hospital via helicopter, where she died from her injuries. Her husband, a passenger in the vehicle she was driving, was taken to a medical center with injuries to his upper extremities. The truck’s driver also suffered injuries to her upper extremities. Police said speed was not a causal factor in the collision; they continue to investigate the accident.
If the woman who passed away is deemed to have caused the crash, her estate may be sued, along with any separate owner of the car she was driving at the time of the crash. Meanwhile, if the other driver is found to have contributed to the crash, she may face a wrongful death lawsuit filed by the loved ones of the deceased driver, as well as a personal injury claim filed by the decedent’s husband. Competent proof of negligence, such as failure to obey traffic laws or driving while distracted, is necessary to establish liability in this type of car accident case in Georgia.
