Teen girl sustains severe personal injury in 1-car crash

A one-car accident may involve a personal injury claim if the vehicle had passengers. Where a car driven recklessly, for example, goes off the road and hits an obstruction the passengers who are injured have a personal injury claim against the driver pursuant to Georgia law. A one-vehicle accident occurred on Wednesday evening, Sept. 25 on Sardis Church Road near Highway 133 in Moultrie.

The Georgia State Patrol is continuing its investigation into the accident. Both the driver and his passenger were reported to be severely injured. The driver, a 25-year-old male from Moultrie, was admitted to Colquitt Regional Medical Center after the wreck. The passenger, a 16-year-old girl from Pelham, was more severely injured than the driver and was taken to the same hospital, according to the Georgia State Patrol.

The details of the car accident were not released because the Georgia State Patrol report was not finished at the time of the press reports. A 911 center log contained a report about a vehicle being driven recklessly and which was speeding near the accident location. The log later contains dispatches in connection with the accident itself. Apparently, the Moultrie Fire Department assisted at the scene of the car accident.

The Georgia State Patrol report was partially available and indicated that the driver was operating a 2003 Ford Focus and that the passenger was ejected from the vehicle. If the driver in fact was driving carelessly or recklessly and if his negligence caused the girl's injuries then she has a claim against him for compensation. Generally, where a minor is injured her parents will bring the personal injury action as the natural guardians. When the claim is settled it goes before a state court judge in Georgia for final approval of the minor's claim.
