An auto accident recently led to the deaths of two people in Georgia. The car accident occurred on a recent Thursday. It took place at about 5:48 p.m.
According to police, a 33-year-old driver and her three passengers were headed north on a road in a sports car. That is when the car left the roadway and ended up on the east shoulder. The woman over-corrected and entered the lane going south. The sports car hit a compact SUV that a man, 42, was driving south. The three sports car passengers were juveniles related to the driver.
None of the passengers in the sports car were reportedly wearing their safety belts. One of the juveniles, a 14-year-old boy, was thrown from the vehicle and pronounced dead at the crash scene. The compact SUV driver suffered injuries and was taken to the hospital, where he died. Charges are pending blood alcohol test results, and they may include DUI vehicular homicide felony or vehicular homicide misdemeanor as well as charges related to the lack of child safety restraints (three counts). Georgia officials said more than 1,400 people lost their lives on Georgia roads last year, with a quarter of these deaths being alcohol related.
The family members of the compact SUV driver who died in this Georgia car accident may decide to file a wrongful death claim against the sports car driver, seeking damages. If this driver ends up being charged and later convicted in criminal court, proof of the convictions may be offered as evidence in a related civil court proceeding to try to establish liability. Once liability has been formally established, claims for monetary damages will be adjudicated. In addition, the estate of the deceased juvenile who was related to the sports car driver may file a wrongful death claim, which would typically be settled through the driver’s insurance coverage.
