The Yamaha Rhino all-terrain vehicles (ATV) have seriously injured and maimed drivers and passengers in many cases since hitting the United States market in 2003. The Rhino's narrow wheelbase, high center of gravity, quick acceleration, and fast turning radius make it susceptible to danger rollover accidents. When a Yamaha Rhino tips or rolls over, the driver's or passenger's leg can come out of the vehicle and be crushed by the roll bar. As with crush injuries, these are difficult to treat and have resulted in some cases of amputation of the injured party's leg, foot, or toes.
Attorney Robert Smalley has been quoted as stating that, "Yamaha has made no design changes to improve the stability or handling of the Yamaha Rhino, in spite of the availability of safe and inexpensive alternative designs and feasible modifications." He has also charged that "Yamaha must address the Rhino's core stability problems." Yamaha has released this statement to Rhino owners.

Tri-State Crematory Litigation
The Tri-State Crematory case made national news when 339 dead bodies were discovered on the crematory's property. Approximately 2,000 bodies of the deceased that were taken to the crematory between 1996 and 2002 to be cremated. In the case of the 339, their loved ones were given cement dust that they believed were the ashes of the decedents. Of these, only approximately 200 people were positively identified through DNA testing. DNA testing was possible only in those cases where a living relative was available. In the remaining cases, it is unlikely that positive identifications will ever be made.
Robert Smalley, a partner here at McCamy, Phillips, Tuggle, & Fordham, was a principal attorney on the Northern Georgia class-action lawsuit. The class-action lawsuit resulted in a $36 million settlement for the families and loved ones of the decedents who bodies were improperly disposed of.
Brent Marsh, the owner and operator of Tri-State Crematory was indicted on over 787 federal criminal charges.
